Some Accutane Inflammatory Bowel Disease Lawsuits Remain Ambiguous



A number of patients of the acne drug Accutane have experienced serious side effects as a result of the drug, which have led a number of them to file lawsuits against the drug makers. Some lawsuits have already been decided but others are in a more ambiguous state. One of the most recent Accutane side effects trials that went to court in New Jersey was declared a mistrial, meaning that the case will have to be evaluated again in court. 

The plaintiff in the case that had been ruled a mistrial was Chetan P. Tanna, acting as parent and guardian ad litem for the victim of the side effects, Priya Tanna. Priya Tanna, according to her Accutane lawsuit, began taking Accutane when she was fifteen years old. After a while, she began to experience symptoms, and was eventually diagnosed with inflammatory bowel disease. 
Inflammatory bowel disease has long been linked to Accutane, and many believe that it was one of the main reasons that the drug was pulled from the market in 2009, although drug maker Roche claims that the decision was made because of generic competition. The allegations made in Priya Tanna's lawsuit are not unlike those made in a number of other Accutane side effects lawsuits that have been filed nationwide.
One of the pieces of evidence Ms. Tanna's Accutane lawyer submitted was a number of copies of internal Roche documents that suggested that the drug manufacturers were aware of the potential link between Accutane use and inflammatory bowel disease, which could spell trouble for the company if this is shown to be true. The assertion in this and many other Accutane lawsuits is that Roche misrepresented or underrepresented the potential for serious Accutane side effects.
Roche claims that any blame for failing to inform patients of potential side effects associated with Accutane should lie with the patient's dermatologists, who the company has said should be responsible for warning patients of all possible risks. The jury failed to come to an agreement on the trial as the Christmas holidays approached and the case was ruled a mistrial.
A number of Accutane lawsuits have been consolidated in mass tort litigation in New Jersey and will be handled as such; over 6,000 lawsuits are currently pending in the courts. Most of them involve Crohn's disease or ulcerative colitis, two forms of Accutane inflammatory bowel disease.
